All Online Bidders must be preapproved by Fladeboe Land and supply a bank letter of credit. Bidders must also sign the auction day announcements prior to bidding. The deadline to request approval to bid is no later than 24 hours prior to the auction.  

Auction Terms:  The successful bidder(s) will pay down $30,000 per parcel for Parcel 1 and Parcel 2, and/or $10,000 for Parcel 3 as earnest money on auction day in the form of a cashier's check. The non-refundable check should be made out to Fladeboe Land Trust Account. The successful bidder will enter into a non-contingent, AS-IS purchase agreement on auction day. Buyer's premium in the amount of 5% will apply to all parcels. Final price will be determined by the number of surveyed acres for Parcel 1 and Parcel 2. Parcel 3 will be sold by the parcel, with the buyer's premium added to the top bid price on all parcels. Closing will be executed on or before December 22, 2020 at Attorney Brad Schmidt at JMS&K Law Office in Willmar, MN. Upon successful closing possession will be granted. The online bidding will end at the conclusion of the live auction. The end time of the auction listed online is only an estimate. The results of the live simulcast auction are to be determined by the auctioneer. Announcements on the day of the Auction take precedence over all other terms and announcements. The auction day announcements will become a part of the purchase agreement that the successful bidder will be signing.

Execution of Purchase Agreement, Including Auction Terms, and Earnest Money Payment:

Immediately following the auction, the purchase agreement will be sent to the successful online bidder by e-mail, who must deliver it back to the broker by the end of the business day. The Terms of the Auction call for an earnest money deposit to be paid at the close of the auction. An online bidder can make said earnest money deposit by a bank to bank wire transfer. Buyer must either deliver a certified check to the Fladeboe Land Business Office or wire the earnest money funds into the Fladeboe Land Trust Account no later than the end of the next business day. A successful online bidder not executing the purchase agreement by the end of the business day, and/or not depositing the earnest money by the end of the next business day following the conclusion of the auction, will be considered in default. Bidding is not contingent upon financing or any other contingencies. Final cash payment to seller will be on the closing date specified on the sale bill, also read in the opening announcements of the live auction.

By placing a bid you, as the buyer, are agreeing to all the above terms and are legally obligated to fully execute the purchase agreement. 

By registering for the online system, you also agree to be added to the Fladeboe Land email list and will received information regarding upcoming sales.

Technical Problems:  The auction will be conducted live with an online bidding option. Any technical problem that may arise from internet connectivity, hardware, software, human error, or any other such issue, whether on behalf of the Bidder or Auctioneer, may arise at any time without notice. In the event such technical problems arise, neither Auctioneer (and/or their agents/employees) nor the Seller shall be responsible. Auctioneer reserves the right to cancel, postpone and/or extend the bidding time in the event of such technical problems. Any actions the Auctioneer takes shall be final.
